Abstract
The appellant suffered from a number of ailments including chronic fatigue syndrome and weakness in his limbs. The appellant applied for DLA however his claim was rejected by the Department and the Tribunal. The appellant appealed on a number of grounds, inter alia, the decision on the basis that the tribunal noted that there was a lack of clinical findings in relation to the appellant’s disablements and the failure of the tribunal did not consider all four factors in relation to inability to walk, as well as the tribunal erring in comparing the appellant’s ability to drive with tasks involved in meal preparation.
