Abstract
What does the new EU minimum wage directive mean for EU employees in a third country associated with the EU, such as Switzerland? Nothing for the time being, because the EU Commission does not require Switzerland to adopt EU labor law. The bilateral agreements with the EU are about mutual market access and not about the social guard rails that actually belong to the European internal market. This is a design flaw. And that is why Switzerland has independent, accompanying wage protection measures that make it easier for employees from the EU who are posted to Switzerland to enforce their right to higher Swiss wages. The EU minimum wage directive is nevertheless important for all people, including those from the EU, who work in Switzerland, because it sets new social standards that have an impact far beyond the EU's borders.
